FCC Caller ID Rules for Telemarketers: What Compliance Requires

Even before passage of the Truth in Caller ID Act, FCC rules required telemarketers to pass accurate Caller ID information. FCC caller ID rules specifically require that a telemarketer transmit or display its telephone number or the telephone number of the seller on whose behalf the telemarketer is calling, and, if possible, its name or the name and telephone number of the company for which it is selling products or services.

In addition, the FCC rules require telemarketers to display a telephone number that can be called during regular business hours to ask to no longer be called.

Compliance and answer rates aren't at odds

A compliant Caller ID setup can also work in a telemarketer's favor. Since local number programs like Enhanced DialerID launched in 2007, telemarketers using a local phone number tied to the market they're calling into have gained a real competitive advantage: the local number is associated with the CNAM database and the telemarketer can control the name that's displayed, and consumers are simply more likely to answer a local number than a toll-free or out-of-area one. Campaigns using local numbers have been found to increase answer rate by 22-25%, letting companies penetrate their lists further than before thanks to a better contact rate.
