Quality Voice & Data, Inc., including its subsidiaries and affiliates (“QVD,” “we,” “us,” or “our”), provides the information contained on this website or any of the pages comprising the website (“website”) to visitors (“visitors”) (cumulatively referred to as “you” or “your” hereinafter) subject to the terms and conditions set out in these website terms and conditions (“Terms”), the Privacy Policy, the Acceptable Use Policy, and any other relevant terms and conditions, policies and notices which may be applicable to a specific section or module of this website.

These Terms govern your use of this website only. If you purchase or use QVD services, those services are governed by the applicable Master Services Agreement, Service Order(s), and Acceptable Use Policy between you and QVD, and nothing in these Terms modifies, supersedes, or replaces those agreements. By using this website, you represent that you are at least 18 years of age and, if you are using the website on behalf of a company or other entity, that you have authority to bind that entity.

2. Information on the Website

4. Refund Policy

QVD services are billed under the Master Services Agreement and applicable Service Order(s) between QVD and each customer. Any billing dispute or request for a billing adjustment must be made in good faith and in writing within thirty (30) days of the invoice date and will be handled in accordance with the billing dispute provisions of the Master Services Agreement. Amounts not disputed in writing within thirty (30) days of the invoice date are deemed accepted. 7. Specific Use

You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law and you hereby indemnify QVD against any loss, liability, damage or expense of whatever nature which QVD or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such message or material.

QVD respects the intellectual property rights of others. QVD may at any time modify any relevant terms and conditions, policies or notices. When we do, we will post the revised version on this page and update the “Last Updated” date above. You acknowledge that by continuing to use the website after revised terms are posted, you shall become bound to the current version of the relevant terms and conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.

12.3 Conflict

Where any conflict or contradiction appears between the provisions of these website terms and conditions and any other relevant terms and conditions, policies or notices, the other relevant terms and conditions, policies or notices which relate specifically to a particular section or module of the website shall prevail in respect of your use of the relevant section or module of the website.

Any provision of any relevant terms and conditions, policies and notices, which is or becomes unenforceable in any jurisdiction, whether due to voidness, invalidity, illegality, unlawfulness or for any reason whatever, shall, in such jurisdiction only and only to the extent that it is so unenforceable, be severed and given no effect, and the remaining provisions of any relevant terms and conditions, policies and notices shall remain in full force and effect.

12.7 Applicable Laws

Any relevant terms and conditions, policies and notices shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any principles of conflict of law. You hereby consent to the exclusive personal jurisdiction and venue of the federal and state courts located in Nassau County, New York, in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices or any matter related to or in connection therewith.

13. Free Tools

Our free tools, including the Caller ID Testing lookup, are provided for evaluating numbers you own or are authorized to manage. They return a point-in-time result and carry no warranty or service level. Each lookup costs us a paid query, so usage is capped per day and per network, and scripted or automated access, scraping, and attempts to evade those limits are not permitted.

To enforce this we record the IP address requests come from, apply bot protection, and pass a one-way hashed form of that address to the service fulfilling the lookup. See our Privacy Policy for the detail.
